Privacy Policy

At Ecuchasqui S.A.S. (hereinafter "Ecuchasqui", "we") we process the personal data of our enquirers under the Organic Law for the Protection of Personal Data of Ecuador (LOPDP), published in Official Registry Supplement 459 of 26 May 2021, and its regulations in force in 2026. This document explains in plain language what we collect, why, with whom we share it, and how you can exercise your rights.
1. Data controller

2. What data we collect
Through the contact form we only collect: your name, email address, and the content of the message you choose to include. Automatically, and only if you accept the corresponding cookies, we collect browsing data (approximate device identifier, visited pages, time on page, campaign of origin). We do not collect sensitive data or financial information via the site form.
3. Why we use your data
We use your data to: (a) respond to your enquiry and send you the sheets of the active projects in your province; (b) keep an internal record of contacts for accounting and audit purposes; (c) measure the effectiveness of our information campaigns, provided you have given prior consent. We do not use your data for automated decisions that produce legal effects on you.
4. Legal basis
The main legal basis is your free, specific and informed consent when you submit the form. Additionally, certain processing operations rely on the fulfilment of legal obligations (accounting, tax) and on Ecuchasqui's legitimate interest in preventing fraud.
5. Who we share it with
We share data only with: (i) technology infrastructure providers located in the European Union or the United States, under processing agreements with standard contractual clauses; (ii) Ecuadorian authorities when there is a duly motivated judicial request. We do not sell personal data to third parties.
6. International transfers
When we transfer data outside Ecuador (for example, servers in the European Union), we apply the safeguards required by LOPDP: contracts with standard clauses approved by the Ecuadorian Data Protection Superintendency or equivalent mechanisms in force in 2026.
7. Retention period
We keep the form data for a maximum of twenty-four (24) months from the last contact, unless there is a legal obligation to keep it longer (for example, seven years for accounting records).
8. Your rights
You may exercise your rights of access, rectification, updating, erasure, objection, portability and the right not to be subject to automated decisions by writing to privacidad@ecuchasqui.com attaching a copy of your ID. We respond within a maximum of fifteen (15) business days. If you believe your request has not been addressed, you may complain to the Ecuadorian Data Protection Superintendency.
9. Security
We apply reasonable technical and organisational measures: encryption in transit (TLS 1.3), role-based access control, periodic reviews of suppliers and annual staff training in data protection.
10. Changes to this policy
We publish any material change with at least thirty (30) days' notice. The current version always bears the date shown at the top of this document.
